Terms and Conditions
General Terms and Conditions (GTC) of the organiser AVIGAN EVENTS (conexio, Christoph Boldt, Rohr 10a, 79271 St. Peter)
- Scope of Application
1.1 These GTC apply to all contracts concluded by the organiser with customers (natural or legal persons) in connection with the purchase of tickets for concerts and other performances.
1.2 Any deviating, conflicting or supplementary general terms and conditions of the customer shall only apply if the organiser has expressly agreed to their validity in writing. - Contracting Party, Conclusion of Contract
2.1 The contracting party is the organiser AVIGAN EVENTS, Christoph Boldt, Rohr 10a, 79271 St. Peter, Tel.: 07660 2144755, mail@avigan.events.
2.2 The contract is concluded upon the purchase of a ticket or the confirmation of the order. The customer will receive confirmation by email or at the point of purchase. - Tickets and admission
3.1 Tickets are personal and non-transferable, unless otherwise stated.
3.2 The organiser reserves the right to refuse admission to persons (e.g. due to house rules, misuse of tickets, breaches of public order).
3.3 Admission takes place in accordance with the scheduled start times for the event. Late admission may be possible but cannot be guaranteed.
3.4 Photography and audio recordings during the event require the consent of the organiser and, where applicable, the artists. - Prices, Payment, Cancellation4.1 All prices include applicable VAT, unless otherwise stated.
4.2 Payment shall be made using the payment methods specified during the ordering process.
4.3 Cancellation, exchange or refund of tickets is subject to the terms and conditions set out in the offer or on the event page. Unless otherwise stated, there is no entitlement to a refund if the event is not attended.
4.4 In the event of cancellation or interruption of the event by the organiser, the ticket price will be refunded or a replacement event offered, where permitted by law. - Right of withdrawal
5.1 Consumers are entitled to a right of withdrawal for distance contracts in accordance with statutory provisions. The exact time limits and conditions are governed by the applicable legal provisions. Information on this can be found in the confirmation/on the event page. - Changes and Cancellations
6.1 The organiser reserves the right to change programme items as necessary (e.g. line-up, times, seating allocation) without refund, provided that the functional purpose of the event is not significantly impaired.
6.2 If an event is cancelled by the organiser, supplementary refund rules apply in accordance with clause 4.3. - Liability
7.1 The organiser shall only be liable for damage resulting from wilful misconduct or gross negligence. In cases of simple negligence, the organiser shall only be liable for breaches of fundamental contractual obligations (cardinal obligations), limited to typical, foreseeable damage.
7.2 Liability for injury to life, limb or health remains unaffected.
7.3 The organiser has no specific duty to safeguard valuables; the customer is responsible for their own belongings. - Data Protection
8.1 The collection, processing and use of personal data shall be carried out in accordance with the organiser’s data protection policy and applicable data protection laws.
8.2 Data shall be used solely for the purposes of organising the event, invoicing and communication. - Final Provisions
9.1 Should any provision of these General Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by one that comes closest to the economic purpose.
9.2 The law of the country in which the organiser has its registered office shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
9.3 The place of jurisdiction shall be the organiser’s registered office, insofar as permitted by law.
