Terms and Conditions
General Terms and Conditions (GTC) of the organiser AVIGAN EVENTS
- Scope of application
1.1 These GTC apply to all contracts concluded by the organiser with customers (natural or legal persons) in connection with the purchase of tickets for concerts and other performances.
1.2 Any deviating, conflicting or supplementary general terms and conditions of the customer shall only apply if the organiser has expressly agreed to their validity in writing.
- Contractual partner, conclusion of contract
2.1 The contractual partner is the organiser AVIGAN EVENTS, Christoph Boldt, Rohr 10a, 79271 St. Peter, Tel.: 07660 2144755, mail@avigan.events.
2.2 The contract is concluded upon purchase of a ticket or confirmation of the order. The customer will receive confirmation by email or at the place of purchase.
- Tickets and admission
3.1 Tickets are personal and non-transferable, unless otherwise stated.
3.2 The organiser reserves the right to refuse admission to persons (e.g. due to house rules, misuse of tickets, administrative offences).
3.3 Admission is granted according to the meeting or event times. Late admission may be possible, but cannot be guaranteed.
3.4 Photography and audio recordings during the event require the consent of the organiser and, if applicable, the artists.
- Prices, payment, cancellation
4.1 All prices include applicable value added tax, unless otherwise stated.
4.2 Payment shall be made in accordance with the payment methods specified in the order process.
4.3 Cancellation, exchange or refund of tickets is governed by the regulations specified in the offer or on the event page. Unless otherwise stated, there is no entitlement to a refund if the event is not attended.
4.4 If the event is cancelled or terminated by the organiser, the ticket price will be refunded or a replacement event offered, if legally permissible.
- Right of withdrawal
5.1 Consumers have a right of withdrawal for distance contracts in accordance with statutory provisions. The exact deadlines and conditions are governed by the applicable legal situation. Information on this can be found in the confirmation/on the event page.
- Changes and cancellations
6.1 The organiser reserves the right to change programme items as necessary (e.g. cast, times, seat allocation) without refund, provided that the functional purpose of the event is not significantly impaired.
6.2 If an event is cancelled by the organiser, supplementary refund rules apply in accordance with point 4.3.
- Liability
7.1 The organiser shall only be liable for damages resulting from intent or gross negligence. In cases of simple negligence, the organiser shall only be liable for breaches of essential contractual obligations (cardinal obligations), limited to typical foreseeable damages.
7.2 Liability for injury to life, limb and health remains unaffected.
7.3 The organiser has no special duty to safeguard valuables; the customer is responsible for their own belongings.
- Data protection
8.1 The collection, processing and use of personal data is carried out in accordance with the organiser’s data protection policy and the applicable data protection laws.
8.2 Data will only be used for the purpose of organising the event, billing and communication.
- Final provisions
9.1 Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by one that comes closest to the economic purpose.
9.2 The law of the country in which the organiser is based shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
9.3 The place of jurisdiction shall be the organiser’s registered office, insofar as this is legally permissible.
